The terms that govern your use of this website and our services.
Last updated: October 2026
These Terms & Conditions govern the supply of goods and services by J.P.B Fabrication Pty Ltd (“the Supplier”, “we”, “us”) to the customer (“the Customer”, “you”). By accepting a quote or placing an order, the Customer agrees to these terms.
Quotes are valid for 30 days unless stated otherwise. A quote is an invitation to treat, and no contract is formed until the Supplier confirms the order in writing. The scope of work in the accepted quote forms the basis of the contract. Variations are quoted separately and must be agreed in writing before work proceeds.
If the Customer cancels an order after acceptance, the Customer must pay for work already performed, materials purchased or committed, and any restocking or freight costs incurred. Changes to the scope, materials or timing of a job may affect the price and delivery date, and will be confirmed in writing.
Prices are as stated on the accepted quote. Unless otherwise agreed in writing, payment terms are net 7 days from the invoice date for commercial accounts, and payment in advance for one-off or private work. The Supplier may require a deposit before commencing work. Late payments may accrue interest at the rate prescribed under applicable Queensland law, and the Customer is liable for reasonable costs incurred in recovering unpaid amounts.
The Customer warrants that any drawings, plans, specifications or materials supplied are accurate, complete and fit for the intended purpose, and that the Customer is entitled to use them. The Supplier is not liable for defects, delays or additional costs arising from inaccurate or incomplete Customer-supplied information.
Unless otherwise specified, goods are fabricated to the dimensions and tolerances stated on the drawings or quote, and to accepted industry practice for the material and process. Standard commercial tolerances apply where no tolerance is specified.
Delivery dates are estimates unless stated as firm in writing. The Supplier is not liable for delay caused by events outside its reasonable control. Risk in goods passes to the Customer on delivery, or on collection if the Customer collects the goods.
The Supplier warrants that goods will be fabricated in a workmanlike manner consistent with industry practice and the agreed specification. The Customer must inspect goods on delivery and notify the Supplier in writing of any defect within 7 days. The Supplier's liability for defects is limited, at its option, to repair, replacement or a refund of the affected goods, to the extent permitted by law.
Nothing in these terms excludes the Customer's rights under the Australian Consumer Law, including the consumer guarantees, where they apply.
Where the Supplier installs work on the Customer's site, the Customer must provide safe access, adequate services and accurate information about existing services, isolation points and site conditions. The Customer is responsible for site safety unless otherwise agreed in writing. The Supplier may suspend work where the site is unsafe or access is restricted.
The Customer must provide all information, access and approvals reasonably required to complete the work, and must ensure that any necessary permits or consents are obtained before installation commences unless the parties agree otherwise.
Drawings, plans and designs prepared by the Supplier remain the property of the Supplier unless otherwise agreed in writing. The Customer may use them only for the purpose of the relevant project.
Risk in goods passes to the Customer on delivery. Title to the goods does not pass until the Supplier receives payment in full. Until title passes, the Supplier may enter the Customer's premises to recover unpaid goods.
To the extent permitted by law, the Supplier is not liable for indirect or consequential loss, loss of profit, loss of production, or downtime arising from the supply of goods or services. The Supplier's total liability in connection with an order is limited to the value of that order.
Either party may terminate an order on written notice if the other party commits a material breach that is not remedied within 14 days of notice. Termination does not affect accrued rights or obligations, including the Customer's obligation to pay for work completed.
The Supplier is not liable for failure or delay caused by events beyond its reasonable control, including fire, flood, severe weather, industrial action, supply shortages, or government restrictions.
These terms are the entire agreement between the parties for the relevant order and supersede any prior discussions. If any provision is unenforceable, the remaining provisions continue in effect. A party's failure to enforce a right is not a waiver of that right.
These terms are governed by the laws of Queensland, Australia, and the parties submit to the exclusive jurisdiction of the courts of Queensland.
